De nombreuses provinces et territoires canadiens disposent de lois obligeant les \u00e9coles \u00e0 cr\u00e9er des environnements d'apprentissage s\u00fbrs et \u00e0 lutter contre les brimades, y compris les brimades homophobes et transphobes. En voici un exemple :<\/p>\n<ul>\n<li><a href=\"https:\/\/www.canlii.org\/en\/ns\/laws\/stat\/sns-2018-c-1-sch-a\/latest\/sns-2018-c-1-sch-a.html\" target=\"_blank\" rel=\"noopener\"><strong>Nouvelle-\u00c9cosse<\/strong><\/a>: Le <em>Loi sur l'\u00e9ducation <\/em>stipule que les directeurs d'\u00e9cole et les enseignants doivent prendre des mesures raisonnables pour cr\u00e9er et maintenir un environnement d'apprentissage s\u00fbr.<\/li>\n<li><a href=\"https:\/\/canlii.ca\/t\/8ghf#sec41\" target=\"_blank\" rel=\"noopener\"><strong>Manitoba<\/strong><\/a><strong>: <\/strong>Le <em>Loi sur les \u00e9coles publiques <\/em>stipule que les \u00e9coles doivent avoir des politiques qui respectent la diversit\u00e9 humaine et qui promeuvent et renforcent un environnement d'apprentissage s\u00fbr et inclusif.<\/li>\n<li><a href=\"https:\/\/canlii.ca\/t\/xfl#sec75.1\" target=\"_blank\" rel=\"noopener\"><strong>Qu\u00e9bec<\/strong><\/a>: Le <em>Loi sur l'\u00e9ducation <\/em>indique que les conseils scolaires doivent disposer de plans de lutte contre les brimades qui incluent des plans de pr\u00e9vention des brimades et de la violence homophobes.<\/li>\n<li><a href=\"https:\/\/yukon.ca\/en\/sexual-orientation-and-gender-identity-policy\" target=\"_blank\" rel=\"noopener\"><strong>Yukon<\/strong><\/a><strong>: <\/strong>La politique en mati\u00e8re d'orientation sexuelle et d'identit\u00e9 de genre stipule que les brimades homophobes ne seront pas tol\u00e9r\u00e9es dans les \u00e9coles et que le personnel scolaire doit intervenir dans toutes les situations o\u00f9 des insultes homophobes sont utilis\u00e9es ou des brimades homophobes se produisent.<\/li>\n<li><a href=\"https:\/\/canlii.ca\/t\/2c0#sec301\" target=\"_blank\" rel=\"noopener\"><strong>Ontario<\/strong><\/a>: Le <em>Loi sur l'\u00e9ducation <\/em>indique que le gouvernement doit \u00e9tablir des politiques qui identifient et pr\u00e9voient des cons\u00e9quences et des r\u00e9ponses appropri\u00e9es aux brimades homophobes, transphobes et biphobes.<\/li>\n<li><a href=\"https:\/\/news.gov.bc.ca\/factsheets\/sexual-orientation-and-gender-identity-sogi-in-schools\" target=\"_blank\" rel=\"noopener\"><strong>Colombie-Britannique<\/strong><\/a><strong>: <\/strong>En 2016, la Colombie-Britannique a exig\u00e9 que tous les districts scolaires et les \u00e9coles ind\u00e9pendantes ajoutent des r\u00e9f\u00e9rences sp\u00e9cifiques \u00e0 l'orientation sexuelle et \u00e0 l'identit\u00e9 de genre dans leurs politiques de lutte contre les brimades.<\/li>\n<\/ul>\n<p>Certaines provinces n'ont pas explicitement de lois contre les brimades, mais m\u00eame en l'absence de formulation explicite, les \u00e9coles sont tenues de prot\u00e9ger ta s\u00e9curit\u00e9. Il s'agit notamment de te prot\u00e9ger contre les brimades fond\u00e9es sur ton orientation sexuelle et ton identit\u00e9 de genre. Les brimades, en particulier les brimades homophobes et transphobes, nuisent \u00e0 ta s\u00e9curit\u00e9 parce qu'elles peuvent causer des dommages physiques et psychologiques.<\/p>\n\t<\/div>\n<\/div>\n\n\n\n\n\t\t<\/div> \n\t<\/div>\n\t<\/div> \n\n\t<div style=\"\" class=\"vc_col-sm-5 stats wpb_column column_container vc_column_container col child_column padding-4-percent inherit_tablet inherit_phone\"  data-using-bg=\"true\" data-padding-pos=\"all\" data-has-bg-color=\"true\" data-bg-color=\"#8a8ace\" data-bg-opacity=\"0.2\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" ><div class=\"column-bg-overlay-wrap column-bg-layer\" data-bg-animation=\"none\"><div class=\"column-bg-overlay\" style=\"opacity: 0.2; background-color: #8a8ace;\"><\/div><\/div>\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<div class=\"nectar-highlighted-text font_size_3em\" data-style=\"text_outline\" data-outline-thickness=\"thick\" data-user-color=\"true\" style=\"color: #49479d;\" data-using-custom-color=\"false\" data-animation-delay=\"false\" data-color=\"\" data-color-gradient=\"\"><h3 class=\"vc_custom_heading vc_do_custom_heading\"><em>Le plaidoyer en action :<\/em><\/h3>\n<\/div><h4 style=\"color: #49479d;text-align: left\" class=\"vc_custom_heading vc_do_custom_heading\" >Un \u00e9l\u00e8ve victime de brimades homophobes est indemnis\u00e9 par l'\u00e9cole pour discrimination<\/h4>\n<div class=\"wpb_text_column wpb_content_element\" >\n\t<div class=\"wpb_wrapper\">\n\t\t<p>En 2002, un lyc\u00e9en de Vancouver nomm\u00e9 Azmi Jubran <a href=\"https:\/\/www.canlii.org\/en\/bc\/bchrt\/doc\/2002\/2002bchrt10\/2002bchrt10.html?resultId=7a39c91a7e5347d49b82579eb530ea15&amp;searchId=2025-09-09T15:33:23:156\/4c4afb2896004b2685f146e11c68639c\" target=\"_blank\" rel=\"noopener\">a d\u00e9pos\u00e9 et obtenu une plainte pour violation des droits de l'homme<\/a> contre son conseil scolaire. Sa plainte indiquait que le conseil scolaire ne l'avait pas prot\u00e9g\u00e9 contre la discrimination et le harc\u00e8lement. Bien qu'il ne s'identifie pas comme homosexuel, il a \u00e9t\u00e9 victime de harc\u00e8lement en raison de son homosexualit\u00e9. <em>per\u00e7ue <\/em>l'orientation sexuelle. Il a \u00e9t\u00e9 harcel\u00e9 \u00e0 plusieurs reprises avec des insultes homophobes, agress\u00e9 physiquement, on lui a crach\u00e9 dessus et sa chemise a m\u00eame \u00e9t\u00e9 br\u00fbl\u00e9e. Le Tribunal des droits de l'homme a conclu que le conseil scolaire d'Azmi \"n'a pas fourni un environnement \u00e9ducatif exempt de harc\u00e8lement discriminatoire\". Le conseil scolaire a \u00e9t\u00e9 condamn\u00e9 \u00e0 indemniser Azmi pour l'atteinte \u00e0 sa dignit\u00e9. Cette affaire montre que les \u00e9coles peuvent \u00eatre tenues pour responsables si elles ignorent la discrimination et le harc\u00e8lement.<\/p>\n\t<\/div>\n<\/div>\n\n\n\n\n\t\t<\/div> \n\t<\/div>\n\t<\/div> \n<\/div><\/div>\n\t\t\t<\/div> \n\t\t<\/div>\n\t<\/div> \n<\/div><\/div>","protected":false},"excerpt":{"rendered":"The Right to Security of the Person: Safety and Freedom from Violence, Bullying, and Harassment Home Do schools have to prevent bullying?
