This right sometimes appears explicitly in policies and laws, and in CCLA\u2019s view, is also grounded in section 15 of the <em>Charter, <\/em>the <a href=\"https:\/\/queerstudentrights.ca\/your-rights\/the-right-to-equality-freedom-from-discrimination\/\">right to equality and the right to be free from discrimination<\/a>.<\/p>\n<p>Inclusion in school activities can be particularly important for trans and non-binary students when faced with gender-segregated school activities, like sports. Some provinces or school boards have specific policies that allow the inclusion of trans students to participate in gender-segregated school activities in accordance with their gender identity. For example:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.edu.gov.mb.ca\/k12\/docs\/support\/transgender\/full_doc.pdf\" target=\"_blank\" rel=\"noopener\">Guidelines<\/a> from <strong>Manitoba<\/strong>\u2019s Ministry of Education and Training say that \u201c[a]ll students, regardless of their gender identity or expression, should be able to participate in physical education classes and extracurricular activities, including competitive and recreational athletic teams, in a safe, inclusive, and respectful environment. Trans and gender diverse students have the right to participate in such classes and activities in ways that are safe and comfortable and consistent with their gender identity.\u201d<\/li>\n<li><strong>Nova Scotia<\/strong>\u2019s <a href=\"https:\/\/studentservices.ednet.ns.ca\/sites\/default\/files\/Guidelines%20for%20Supporting%20Transgender%20Students_0.pdf\" target=\"_blank\" rel=\"noopener\"><em>Guidelines for Supporting Transgender and Gender-nonconforming Students<\/em><\/a> explains that: \u201cA student\u2019s self-identification is the sole measure of the student\u2019s gender identity. It is not acceptable to require a transgender or gender-nonconforming student to participate in activities based on sex assigned at birth or status of medical transition.\u201d<\/li>\n<li>In supporting trans students\u2019 right to participate in sports and P.E. classes, the <a href=\"https:\/\/www.tdsb.on.ca\/Portals\/0\/docs\/tdsb%20transgender%20accommodation%20FINAL_1_.pdf\" target=\"_blank\" rel=\"noopener\">Toronto District School Board\u2019s policy<\/a> notes that \u201cIt is not an acceptable accommodation to deny a student the opportunity for physical education,\u201d such as by forcing trans students to choose an independent study, or not allowing them to take P.E.<strong>\u00a0<\/strong><\/li>\n<\/ul>\n<\/div>\n\n\n\n<div id=\"fws_6a8e59cbd579b\" data-midnight=\"\" data-column-margin=\"40px\" class=\"wpb_row vc_row-fluid vc_row inner_row vc_row-o-equal-height vc_row-flex vc_row-o-content-middle\"  style=\"\"><div class=\"row-bg-wrap\"> <div class=\"row-bg\" ><\/div> <\/div><div class=\"row_col_wrap_12_inner col span_12  left\">\n\t<div style=\"\" class=\"vc_col-sm-12 stats wpb_column column_container vc_column_container col child_column padding-4-percent inherit_tablet inherit_phone \"  data-using-bg=\"true\" data-padding-pos=\"all\" data-has-bg-color=\"true\" data-bg-color=\"#666666\" data-bg-opacity=\"0.2\" data-animation=\"\" data-delay=\"0\" >\n\t\t<div class=\"vc_column-inner\" ><div class=\"column-bg-overlay-wrap column-bg-layer\" data-bg-animation=\"none\"><div class=\"column-bg-overlay\" style=\"opacity: 0.2; background-color: #666666;\"><\/div><\/div>\n\t\t<div class=\"wpb_wrapper\">\n\t\t\t<div class=\"nectar-highlighted-text font_size_3em \" data-style=\"text_outline\" data-outline-thickness=\"thick\" data-user-color=\"true\" style=\"color: #020000;\" data-using-custom-color=\"false\" data-animation-delay=\"false\" data-color=\"\" data-color-gradient=\"\" style=\"\"><h3 class=\"vc_custom_heading vc_do_custom_heading\"><em>Moves Against Rights:<\/em><\/h3>\n<\/div><h4 style=\"color: #020000;text-align: left\" class=\"vc_custom_heading vc_do_custom_heading\" >Alberta Sports<\/h4>\n<div class=\"wpb_text_column wpb_content_element \" >\n\t<p>In 2025, the Alberta government implemented <a href=\"https:\/\/docs.assembly.ab.ca\/LADDAR_files\/docs\/bills\/bill\/legislature_31\/session_1\/20230530_bill-029.pdf\" target=\"_blank\" rel=\"noopener\">new laws<\/a> that ban trans women and girls from competing in women\u2019s sports. <a href=\"https:\/\/www.cbc.ca\/news\/canada\/edmonton\/alberta-female-trans-athlete-ban-1.7554900\" target=\"_blank\" rel=\"noopener\">This law mandates<\/a> schools, universities, and sports clubs to make female-only sports leagues accessible only to people who were born female at birth. The policy establishes a \u201cformal complaints process\u201d allowing Albertans to question the eligibility of female athletes and allows for the investigation of an athlete\u2019s sex at birth through examination of birth records. A birth record is a document that individuals are not able to change; they are different than birth certificates.<\/p>\n<p>The CCLA considers this policy clearly discriminatory and a violation of the rights of trans women and girls. His principal said that allowing Marc to bring a same-sex partner to a school dance would be condoning same-sex activity, which was against the Catholic church\u2019s teaching. In an injunction (a court order requiring a person to do or stop doing something), <a href=\"https:\/\/www.canlii.org\/en\/on\/onsc\/doc\/2002\/2002canlii49475\/2002canlii49475.html?resultId=2324d9e000f0483280d2e0b70e5373d6&amp;searchId=2025-09-09T13:50:07:826\/247a44597fe24a7d9bad993eef73f39d\" target=\"_blank\" rel=\"noopener\">the court ordered<\/a> the school to allow Marc to bring his boyfriend to prom.
